**Membership Conditions**

Our loyalty program (the "Program") is open to any interested individual for personal use only, with a limit of one account per person. Companies, associations, or any other legal entities are not eligible to participate in the Program. Individuals aged 18 or older and who are legal residents of France are eligible to become members of the Program. THE DIFFERENT COMPANY reserves the right to exclude any member found not to be in compliance with these General Terms and Conditions.

By becoming a member of the Program, you are deemed to have read, understood, and fully accepted these general terms and conditions applicable to the Program (the "General Terms and Conditions") and any potential modifications made to them. These General Terms and Conditions are independent of any other general terms related to the purchase of our products or other existing programs or agreements.

By joining the Program, you also agree to be bound by our Personal Data Protection Policy and the general terms of use of the website www.thedifferentcompany.com. If you do not expressly accept the General Terms and Conditions, our Privacy Policy, and the general terms of use of the website www.thedifferentcompany.com, you cannot participate in the Program. Membership in the Program and its benefits is at the sole discretion of THE DIFFERENT COMPANY, which may terminate the Program or modify the membership conditions, operating rules, or benefits offered at any time by posting the modified elements on the website www.thedifferentcompany.com. Your continued participation in the Program after these publications constitutes your agreement to the changes made.

**Program Registration**

You have the option to register in-store or online. To register for the Program and benefit from its advantages, you must have a THE DIFFERENT COMPANY customer account (the “Account”), with the opening of an Account automatically leading to Program membership.

In any case, registration is completely free and without purchase obligation. Only one Account can be associated with an email address. In the event of a dispute over Account ownership, the Program member will be deemed the owner of the email address provided at registration. Thus, the authorized Account holder is the individual to whom the applicable email address has been assigned by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

You agree to provide true, accurate, current, and complete information required to create your account, including the information provided to view your Account on the website www.thedifferentcompany.com, and to promptly update this data to keep it accurate, current, and complete. If you provide false, inaccurate, outdated, or incomplete information, or if THE DIFFERENT COMPANY has reasons to suspect that your registration data is false, inaccurate, outdated, or incomplete, or that you are abusing your Program membership in any way, THE DIFFERENT COMPANY has the right to suspend, terminate, or refuse your current or future use of the Program. Each member is solely responsible for maintaining the accuracy and updating the personal information necessary to access their Account by correcting them directly on www.thedifferentcompany.com.

**Purpose and Operation of the Program**

The Program is a way to reward and thank our loyal customers for purchasing our products and participating in our online activities. You can earn points and reach different Program statuses by making eligible purchases or completing various actions. When you earn points and reach statuses, you begin your loyalty journey and can enjoy the benefits and rewards applicable to the achieved status, which may change or be available for a limited time. Eligible purchases and other ways to earn points and reach different Program statuses are posted on www.thedifferentcompany.com or through other media.

The Program is a tiered program determined by the number of points a member has accumulated during a single six-month period on purchases and through eligible activities. Once your account is created, you are automatically enrolled in the loyalty program. From your first collected point, your point balance is valid for six months.

For your purchase to count toward the Program, you must either (1) be logged into your Account if making an online purchase at the time of purchase. However, if your Account is terminated for any reason and you create a new Account, any purchase made before the new Account registration date does not qualify for points. Also, you cannot recover points from your old Account to transfer them to your new Account.

You earn points in various ways:

- You receive five points for every euro, including all taxes, spent on THE DIFFERENT COMPANY products purchased, except for discounted or reduced-price products, on the online store www.thedifferentcompany.com. Eligible purchases include all THE DIFFERENT COMPANY products purchased, including those bought using gift cards, excluding shipping costs. Purchasing a gift card does not earn points, but if you use a gift card to pay for your purchases, you can accumulate points.

In addition to your purchases, you can also earn points for online activities based on the current program on the website and mentioned in our FAQ.

To earn points, please ensure that you are logged into your Account before performing the above actions. The number of points, if any, awarded for each action is determined by THE DIFFERENT COMPANY at its sole and reasonable discretion and is always subject to a maximum number of points earned for each action during the membership period.

Only purchases made through your Account on the online store www.thedifferentcompany.com are eligible for the Program.

**Points are credited:**

- For any paid and non-canceled online purchase on www.thedifferentcompany.com, at the date your package is handed over to the carrier.

**Points are deducted:**

- If credited due to a technical error made by THE DIFFERENT COMPANY.
- If obtained through fraudulent activity or other means that violate these Terms.
- If a purchase is returned or canceled, in whole or in part.
- In case of termination of your Account for any reason.
- In case of non-membership or termination of the email/courier information program.

**Program Benefits and Rewards**

As a Program member, you earn points that determine your points benefits, as well as your status and the advantages of those levels. To redeem offers and rewards, you must have accumulated the minimum number of points as determined by us for a particular benefit. Points can never be exchanged for cash. You must be logged into your Account to use your benefits. Eligible Program members may receive invitations via email or postal mail when rewards are available, provided they have not opted out of receiving Program emails or mail. Some offers may only be sent by email, so you must ensure you share an up-to-date email address.

**Reward Usage Conditions**

The Program's rewards, benefits, and offers are available while stocks last and/or until their expiration date if they are time-limited. Product replacements may be made at our sole discretion. If your online order is not completed for any reason, all offers or rewards will be removed from your cart and will no longer be available. We are unable to resend offers or rewards if they arrive damaged, if you received the wrong one, or if one is missing from your order. In case of a damaged offer or reward, if you received the wrong one, or if one is missing, you can contact THE DIFFERENT COMPANY Customer Service.

**General Provisions**

Neither accounts nor Program rewards, benefits, and/or points can be transferred, shared, or combined. Only the Account associated with the product payment can accumulate rewards, benefits, and/or points. We reserve the right to monitor the number of Accounts per household and to refuse, merge, or close additional or duplicate Accounts at any time. Your Account information (including security information) is confidential and should not be shared with others.

The rewards, benefits, and points earned under the Program have no monetary value, are non-transferable, and you have no ownership rights over the rewards or other Program benefits. Purchase balances and/or points credited to your Account will be reduced or canceled, as applicable, if all or part of a purchase is returned or canceled or if the credit is obtained through fraudulent activity or other means that violate these Terms, as well as due to a technical error made by THE DIFFERENT COMPANY. The sale, exchange, transfer, or assignment of any rewards or benefits offered by the Program, other than by us, is expressly prohibited.

Rewards cannot be exchanged or returned for points, another product or service, or a cash refund.

The products and services available under the Program and any samples we may provide are intended for personal use only. You may not sell or resell any products, services, or samples you purchase or receive from us. We reserve the right to cancel or reduce the quantity of any order to be fulfilled and/or any product or service to be provided to you that, in our opinion and at our sole discretion, may result in a violation of our General Terms and Conditions.

Program points cannot be earned or used for the online purchase of the following products or services:

- Individual or kit samples.
- Products with prior discounts.

Only one discount code obtained under the Program can be used per order. Consequently, discounts cannot be combined on a single order.

**Program Communications**

If you unsubscribe from Program-related communications, you will no longer receive emails regarding your Program status, Program rewards, or any benefits that may be offered to you through the Program.

When creating an Account, please ensure that you are signed up to receive marketing communications. If you agree to receive marketing communications, you must follow the instructions provided in the Program-related emails and on our website at www.thedifferentcompany.com or in the Newsletter Management section.

If multiple members of a household share an email address and/or postal address, those members may choose to receive information and offers associated with a single Account.

We are not responsible for any rewards, benefits, and/or points lost or redeemed due to fraudulent activity by you or a third party.

In the event of membership termination for any reason, all points will be forfeited.

We reserve the right to modify the Program benefits, how you earn points, and reach each Program tier, as well as how we evaluate and reward your eligible purchases and/or any other Program activities. We reserve the right to limit the number of purchases or activities eligible for the Program and/or for a given threshold, the number or types of rewards or benefits you can receive or earn at a given level, within a given period, or for the duration of the Program, and/or any combination of the two options.

If you are concerned that a purchase or other activity has not been correctly applied to your account, you must contact THE DIFFERENT COMPANY’s Customer Service. Your email must include your name and the email address associated with the Program, the date of the Program activity, and the issues you encountered. This email must be sent within a maximum of forty-five (45) days from the date the purchase or Program activity took place. We are not responsible for late notifications regarding purchases or other Program activities that are not credited to an account.

**Termination and Modification**

The Program and its benefits are offered at our sole discretion. We may, at our discretion, cancel, modify, restrict, or terminate these General Terms, our FAQ, and/or the Program or any aspect or feature of the Program at any time without notice, even if such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits.

We reserve the right to exclude you from the Program or to terminate your participation in it and to audit your Account at any time, at our sole discretion. Any suspected abuse of the Program, non-compliance with the General Terms, inactivity for more than 24 months, illegal activity, fraud, misrepresentation, or any other conduct not in accordance with these General Terms and/or detrimental to us or our interests, including, but not limited to, any illegal, fraudulent, and unauthorized use of Program rewards, points, cards, credits, vouchers, coupons, and/or certificates, may result in the revocation of your membership and render you ineligible for future participation in the Program. If your subscription is revoked, the rewards or benefits in your account will automatically expire, your access to the Program and features will be automatically terminated, and your Account will be automatically deleted. If we suspect any illegal activity, fraud, misrepresentation, abuse, or violation of these Terms, we also reserve the right to take appropriate legal action, at our sole discretion.

If you decide that you no longer wish to be part of the Program, you may request the deletion of your Account at any time by contacting THE DIFFERENT COMPANY’s customer service. If you close your Account, you will lose all accumulated points, benefits, and membership status.

**Disclaimer of Warranty - Limitation of Liability**

Neither THE DIFFERENT COMPANY, nor its parent companies, subsidiaries, affiliates, partners, or licensors shall be held liable, contractually, under warranty, or in tort (including negligence) for (a) business interruption; (b) delays or interruptions in access to the Program; (c) non-delivery of data, loss, theft, erroneous delivery, corruption, destruction, or any other alteration; (d) any loss or damage of any kind resulting from transactions or the presence of third-party links on the site or the use of any Program reward or benefit; (e) computer viruses, system failures, or malfunctions that may occur in connection with your use of the site, including during a hyperlink to or from third-party websites; (f) any inaccuracies or omissions in the Program content; or (g) events beyond our control. We make no representations or warranties that defects or errors will be corrected.

Furthermore, neither THE DIFFERENT COMPANY nor its parent companies, subsidiaries, affiliates, partners, or licensors shall be liable for any indirect, special, punitive, incidental, or consequential damages of any kind (including lost profits) related to the Program or your participation, whether contractual, under warranty, or in tort (including negligence).

You agree that no claim or legal action, contractual, under warranty, or in tort (including negligence) arising out of or related to your participation in the Program, the use of any reward or other benefit, or these terms may be pursued by you more than one (1) year after the event giving rise to such claim or action. If you are not satisfied with the Program, terminating your participation in the Program is your sole remedy. We have no other obligations, commitments, or responsibilities to you.

**Indemnification**

You agree to defend, indemnify, and hold us harmless, along with our parent companies, subsidiaries, partners, licensors, officers, directors, employees, and agents, against any loss, damage, or cost, including reasonable attorneys' fees, resulting from any third-party claim, action, or demand arising from your participation in the Program in violation of any law, rule, regulation, or these Terms.

**Governing Law and Disputes**

This Program and these Terms are governed by French law. Any dispute relating to this Program, these Terms, your Program membership, or the relationship between the parties must be submitted to the competent French jurisdiction.

**Privacy**

The personal information collected from you as part of the Program, including but not limited to, purchases made in connection with your Program membership, will be processed by us and our services in accordance with the Personal Data Protection Policy.
